A Basic Overview of Farmworker Occupational Safety and Health Protections for Healthcare Providers
Agricultural work is one of the most dangerous jobs in the U.S. The hazards, in conjunction with the poverty, vulnerability, and lack of knowledge about workplace rights have exacerbated the safety and health of migrant farmworkers. Despite the uniquely dangerous work and vulnerable workforce, few occupational health and safety laws protect farmworkers, and some specifically exclude them.
Farmworkers could benefit from clinicians playing a greater role in the diagnosis, reporting and ultimately, prevention of such injuries. Often, just having basic knowledge about relevant laws and policies aimed at protecting workers rights and health and safety can go a long way in preventing job-related illness and injuries.
The following presentation outlines a few of the federal laws and policies related to sanitation in agricultural fields and pesticides
Further information can be found in the accompanying summaries of each law.
--> A Guide to EPA’s Worker Protection Standard
--> A Guide to OSHA's Field Sanitation Standard
--> A Guide to Federal Insecticide, Fungicide, and Rodenticide Act ( FIFRA)
--> A Guide to Food Quality Protection Act (FQPA)
In addition, the accompanying chart shows where to find more information for each state about pesticide poisoning reporting requirements, legal resources for farmworkers and enforcement agencies for pesticide and field sanitation laws.
